Terms & Conditions
Public summary of the Service Contract. Last updated: May 8, 2026
This English version is an unofficial translation. The Spanish version above is the legally binding text under Colombian law. The complete and binding terms are in the Service Contract both parties sign at the start of the engagement.
1. Who we are
YaEsta.online designs, hosts and maintains informational and promotional websites for restaurants, country retreats, event venues and local shops in Colombia. We operate under Colombian civil and commercial law.
2. What the service includes
The Provider (YaEsta.online) commits to designing, hosting and maintaining a website on the domain selected by the Client. Each plan includes a specific number of monthly modifications and, depending on the plan, business email accounts.
- Basic: COP $490.000 / year (or $49.000 / month) — 2 changes / month.
- Professional: COP $990.000 / year (or $99.000 / month) — 5 changes / month + 1 business email.
- Premium: COP $1.790.000 / year (or $179.000 / month) — 10 changes / month + multiple emails.
- One-time setup: COP $390.000 (launch discount; standard rate $780.000).
3. What counts as a "modification"
A modification is a small change taking under thirty (30) minutes: text, contact info, hours, prices, menu, replacing/adding photos already supplied by the Client, typo fixes.
Not modifications (quoted separately): new pages or sections, new functionality (complex forms, booking systems, payment gateways), full visual redesigns, new content production (photo, video, copy).
Modifications are requested via WhatsApp or email. Maximum response time: three (3) business days. Unused modifications do not roll over to the next month.
4. Term and renewal
The annual contract has an initial term of twelve (12) months and renews automatically. The monthly contract renews month-to-month. Either party may not-renew with sixty (60) days notice before expiration. The Provider sends a renewal notice at least 60 days before expiration.
5. Payment
Colombian pesos (COP). We accept bank transfer, Nequi, Daviplata, Bancolombia and Wise. The setup fee is paid at signing. The annual plan is paid at the start of each period. The monthly plan is paid within the first 5 days of each month.
After 30 days late: site may be suspended. After 90 days late: contract may be unilaterally terminated.
6. Termination by Client
The Client may terminate at any time with thirty (30) days written notice (WhatsApp or email accepted). On a paid annual plan there is no proportional refund for the unused period unless explicitly agreed. Upon termination the Client is entitled to: domain transfer to their name, export of the site as static HTML at no charge, export of associated email accounts if contracted.
7. Termination by Provider
The Provider may terminate with ninety (90) days notice in case of: voluntary cessation of operations, Client default, illegal or law-violating use of the site, or traffic/content load exceeding what is reasonable for a promotional site. If the Provider ceases operations, it will provide at no charge: full static export, email data, formal domain transfer, and proportional refund of unused annual fees.
8. Property rights
- Client property: the domain, content provided (text, photos, logo, brand), and end-user data.
- Provider property: source code, design templates, reusable technical components and methodologies. The Client receives a license to use these during the contract term.
9. Availability and limitation of liability
We commit to keeping the site operational with reasonable availability, understanding that interruptions may occur for maintenance, hosting-provider failures, or force majeure. Total Provider liability is limited to the annual value of the contracted plan. We are not liable for lost profits or indirect damages.
10. Personal data
We treat personal data per Colombian Law 1581 of 2012 and Decree 1377 of 2013. See our Data Treatment Policy for details.
11. Disputes
Disputes are first attempted via direct settlement within thirty (30) days. Without agreement, the parties submit to the ordinary jurisdiction of the civil courts of the Department of Cauca, Republic of Colombia.
12. Acceptance
By contracting our services, the Client declares having read, understood and freely accepted these terms, along with the Service Contract and its annexes signed at the start of the engagement.
